Privacy Policy

Effective date: July 19, 2026

1. INTRODUCTION

This Privacy Policy explains how Darren Zanolini, the owner and operator of cherrytheater.com (the "Site"), collects, uses, discloses, and protects your personal information when you visit the Site, make a purchase, make a donation, create an account, or contact us. This policy applies to information collected through the Site and through communications between you and us. By using the Site you agree to the collection and use of information as described in this policy. If you do not agree with this policy, please do not use the Site.

2. INFORMATION WE COLLECT

Information you provide directly. When you make a purchase or create an account, we collect the information you enter, including your first and last name, email address, telephone number, and billing address. When you contact us through the contact page or by email, we collect your name, your contact details, and the contents of your message. When you make a donation, the payment page operated by Stripe collects the information needed to process it.

Payment information. All payments and donations are processed by Stripe, a third party payment processor. Your card number, security code, and full payment credentials are transmitted directly to Stripe over an encrypted connection and are never received or stored by the Site or by us. We receive only limited transaction information, such as confirmation that a payment succeeded or failed, the amount, the last digits and brand of the card, and the billing details you entered.

Information collected automatically. When you browse the Site, certain technical information is collected automatically by the server and by cookies, including your IP address, browser type and version, operating system, device type, referring pages, the pages you visit and the times you visit them, and session identifiers needed for the shopping cart and login features to function.

3. HOW WE USE YOUR INFORMATION

We use the information we collect to operate the Site and to conduct the transactions you request. Specifically, we use it to process and deliver your orders, to provide access to purchased digital content, to send order confirmations, receipts, and delivery emails, to respond to your questions, requests, and support inquiries, to create and maintain your account, to detect, investigate, and prevent fraud, abuse, and security incidents, to enforce our Terms and Conditions, to comply with legal obligations including tax, accounting, and record keeping requirements, and to establish, exercise, or defend legal claims. We do not use your personal information for automated decision making that produces legal effects concerning you.

4. PAYMENT PROCESSING

Stripe processes all payments and donations made on or through the Site. Stripe collects and handles your payment data as an independent service provider under its own privacy policy, which is available on the Stripe website at stripe.com/privacy. We encourage you to review that policy. Stripe may also use transaction data for fraud detection and prevention as described in its policy. We are not responsible for the privacy practices of Stripe.

5. HOW WE SHARE INFORMATION

We do not sell, rent, or trade your personal information, and we do not share it with third parties for their own marketing purposes. We share personal information only in the following circumstances. With service providers: we share information with vendors who perform services on our behalf, including Stripe for payment processing and our website hosting provider, and only to the extent necessary for them to perform those services. For legal reasons: we may disclose information if we believe in good faith that disclosure is required by law, regulation, subpoena, court order, or other governmental request, or that disclosure is reasonably necessary to protect our rights, property, or safety or the rights, property, or safety of our users or the public, including to detect and prevent fraud. Business transfers: if the Site or substantially all of its assets are transferred to a new owner, personal information may be transferred as part of that transaction, subject to this policy.

6. COOKIES

The Site uses cookies, which are small text files stored by your browser. The cookies used by the Site are functional cookies that are necessary for core features, including keeping items in your shopping cart, maintaining your session while you are logged in, and remembering basic preferences such as language and currency. Payment pages operated by Stripe may set their own cookies for security and fraud prevention. You can configure your browser to refuse or delete cookies, but if you do, parts of the Site, including checkout and login, may not function.

7. ANALYTICS AND DO NOT TRACK

The Site does not currently use third party advertising networks. Standard server logs and functional cookies described above are used to operate and secure the Site. Because there is no common industry standard for responding to browser Do Not Track signals, the Site does not respond to them at this time. If our use of analytics or advertising technologies changes, this policy will be updated accordingly.

8. EMAIL COMMUNICATIONS

We send transactional emails related to your orders and account, such as purchase confirmations, delivery emails, and responses to your inquiries. These messages are part of providing the services you request and cannot be opted out of while you use those services. We will not send you marketing email unless you have agreed to receive it, and any marketing email we send will include a way to unsubscribe.

9. DATA RETENTION

We retain personal information only as long as it is needed for the purposes described in this policy. Order records, including the name, email address, and billing details associated with a purchase, are retained for as long as needed to provide you continued access to your purchases and to satisfy legal, tax, and accounting requirements. Account information is retained for as long as your account remains open and for a reasonable period afterward. Correspondence is retained as long as needed to resolve your inquiry and maintain a record of our communications. Information that is no longer needed is deleted or anonymized.

10. YOUR RIGHTS AND CHOICES

Depending on where you live, you may have rights regarding your personal information, including the right to request access to the information we hold about you, the right to request that inaccurate information be corrected, the right to request deletion of your information, and the right to object to or request restriction of certain processing. You may exercise these rights by contacting us through the contact page on the Site. We will verify your request, respond within the time required by applicable law, and will not discriminate against you for exercising your rights. Note that we may need to retain certain information where required by law, for example records of completed transactions.

California residents. The California Consumer Privacy Act, as amended, gives California residents the right to know the categories and specific pieces of personal information collected about them, the right to request deletion, the right to request correction, and the right not to receive discriminatory treatment for exercising these rights. We do not sell or share personal information as those terms are defined in California law, and we do not use or disclose sensitive personal information for purposes requiring a right to limit.

European Economic Area and United Kingdom visitors. If applicable data protection law of the European Economic Area or the United Kingdom applies to you, our legal bases for processing are the performance of a contract when we process your order, compliance with legal obligations, and our legitimate interests in operating and securing the Site. You have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local supervisory authority.

11. CHILDREN'S PRIVACY

The Site is a general audience website and is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that a child under 13 has provided personal information to the Site, contact us through the contact page and we will delete that information.

12. SECURITY

We take reasonable technical and organizational measures designed to protect personal information against loss, misuse, and unauthorized access, alteration, or disclosure. These measures include encrypted connections to the Site using TLS, restricting administrative access to the Site, and using an established payment processor so that full card details never pass through or reside on our systems. However, no method of transmission over the internet and no method of electronic storage is completely secure, and we cannot guarantee absolute security.

13. INTERNATIONAL VISITORS

The Site is operated from the United States and the information we collect is processed and stored in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, processed in, and stored in the United States, where data protection laws may differ from the laws of your country. Where required by applicable law, we take steps to ensure that transferred personal information receives an adequate level of protection.

14. THIRD PARTY SITES

The Site may contain links to third party websites and services, including social media pages and the Stripe payment pages. This Privacy Policy applies only to the Site. We are not responsible for the content or privacy practices of third party websites, and we encourage you to read the privacy policy of every website you visit.

15. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law. The updated version will be posted on this page with a new effective date and becomes effective when posted. Material changes will be indicated by updating the effective date, and where required by law we will provide additional notice. Your continued use of the Site after an updated policy is posted constitutes your acceptance of it.

16. CONTACT

Questions, concerns, or requests regarding this Privacy Policy or your personal information can be sent through the contact page on cherrytheater.com. We will make reasonable efforts to respond promptly and in any event within the time required by applicable law.
